Terms of Service – RTVSoftware Broadcaster Apps

1. General

These terms of service apply to mobile applications developed and maintained by RTVSoftware, hereinafter referred to as "the app".

The apps are developed on behalf of local and regional broadcasters and provide access to news, information, radio, television and other media content.

By downloading and using the app, you agree to these terms of service, insofar as they are legally applicable.

2. Use of the app

The app is intended for personal, non-commercial use and is in principle available free of charge.

The user may use the app to view and listen to the content offered.

It is not permitted to:

• Use the app for unlawful purposes.
• Intentionally disrupt the operation or security of the app.
• Copy, modify or distribute the app or parts thereof without permission, except as permitted by law.
• Commercially reuse content without permission, unless legally permitted.

3. Content and editorial responsibility

News items, images, audio, video, broadcasts and other editorial content are provided by the relevant broadcaster or external content providers.

The relevant broadcaster is responsible for its own editorial content, including its accuracy, timeliness and completeness.

RTVSoftware provides the technical development and support of the app and has no editorial responsibility for the content published by the broadcaster.

Questions or complaints about news items and broadcasts can be directed to the relevant broadcaster.

4. Availability of the service

RTVSoftware strives for a well-functioning and reliable app.

The availability of certain features also depends on external services, internet connections, streaming providers and the broadcaster's technical systems.

As a result, parts such as live radio, television, news or video may be temporarily unavailable.

RTVSoftware may carry out maintenance, updates and technical changes to improve the operation, security and functionality of the app.

5. External services

The app may use external services, such as YouTube, streaming platforms, social media and third-party websites.

When using these services, additional terms and privacy rules of the relevant providers may apply.

RTVSoftware does not always have influence over the availability, content and operation of these external services.

6. Push notifications

The app may send push notifications about news, important events, broadcasts and other information.

Users can disable push notifications via the settings of their mobile device.

The content and frequency of editorial notifications are, in principle, determined by the relevant broadcaster.

7. Intellectual property

The software, design and technical components of the app are protected by applicable intellectual property rights.

The rights to news items, photos, videos, audio and other editorial content belong to the relevant broadcaster or other rights holders.

Using the app does not grant the user any ownership rights to the software or the content offered.

8. Privacy and personal data

When using the app, personal data may be processed, for example for technical functionalities, push notifications and usage statistics.

How personal data is processed, for which purposes and by which parties, is described in the app's separate privacy policy.

The processing of personal data takes place in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).

9. Liability

RTVSoftware and the relevant broadcaster strive for the correct operation of the app and reliable service.

However, technical malfunctions, interruptions or errors may occur.

To the extent permitted by law, RTVSoftware and the relevant broadcaster are not liable for damage arising solely from malfunctions at external service providers or from circumstances beyond their reasonable sphere of influence.

This provision does not limit any liability that may not be excluded under applicable law and does not affect the legal rights of users.

10. Changes and termination

RTVSoftware may adjust or expand the app or remove features when there is a valid reason to do so, for example technical developments, security or changes in the broadcaster's service.

The availability of an app may also be terminated, for example when cooperation with the relevant broadcaster ends.

In the event of material changes, users will be informed in advance where necessary. Users' legal rights remain applicable.

11. Changes to these terms

These terms of service may be amended when changes in legislation, services or functionality give cause to do so.

The most recent version is made available via the app or the RTVSoftware website.

When legally required, users are informed in advance or consent is requested again.

12. Applicable law

These terms of service are governed by Dutch law, without prejudice to any mandatory consumer protection that applies to the user.
